Where a young adult offender commits a serious firearms offence under s 51D(2) of the Firearms Act 1996 (NSW) involving dealing in prohibited firearms for profit, with prior firearms convictions, the offender's youth cannot dominate sentencing to the extent that it becomes determinative of the sentence at the expense of deterrence and retribution. A sentence of 3 years (NPP 2 years) for possession of four shortened firearms where the maximum is 20 years and the SNPP is 10 years was manifestly inadequate; an appropriate starting point was 7 years (reduced to 5 years 3 months after a 25% guilty plea discount).
