A juror reading newspaper reports of a trial and bringing clippings into the jury room does not constitute a prohibited inquiry under s 68C of the Jury Act 1977 (NSW), because the prohibition focuses on obtaining extraneous information not presented in evidence. Such conduct does not, without more, constitute misconduct requiring discharge under s 53A. The adequacy of a trial judge's inquiry into potential juror misconduct will be assessed by reference to what further inquiries were requested at trial.
