The show cause requirement under s 16A of the Bail Act 2013 (NSW) does not require an accused to demonstrate 'special or unusual circumstances'; such a gloss cannot be added to the statutory test, particularly given that s 22(1) specifically imposes that requirement only in limited circumstances. Police opinions that bail should be refused cannot be considered under s 18, but police assertions about bail-relevant factors may be received under s 31 and given weight according to the factual detail supporting them. In cases of organised violent crime involving firearms, the nature of the offending may itself create an unacceptable risk of further offences that cannot be mitigated by bail conditions.
