A trial judge's response to a jury question about inability to agree must not refer to the cost, time, or inconvenience of a retrial, as such references are apt to impose undue pressure on jurors to compromise their views. The statement that 'we would all have to go through the whole process again' compounds the error by implying jurors are not performing their duties if they do not agree. Where mixed verdicts are returned following such a direction, the possibility of compromise verdicts is a real one warranting a new trial.
