Where accumulation of a sentence on an earlier sentence results in an overall non-parole period that is approximately 83% of the overall term, and this is inconsistent with the sentencing judge's stated intention of a 'notional accumulation', the accumulation is excessive and unwarranted. On resentencing for offences committed in the same period but prosecuted at different times, the proper approach is to assess the likely sentence if all offences had been dealt with at the same time.
