Where pre-sentence custody has been taken into account by one court in sentencing for certain offences, a subsequent sentencing court is not required to give the offender the full benefit of the same period of custody again when sentencing for a different offence in respect of which the offender was simultaneously bail refused. An appellant may not pursue on appeal a contention contrary to the position adopted by counsel below.
