Section 21A(5A) of the Crimes (Sentencing Procedure) Act 1999 (NSW) does not apply merely because an offender's domestic relationship with the victim's parent created the environment in which child sexual offences could be committed. The subsection is directed to whether the offender's good character facilitated the commission of the offence, such as where the offender used a community role (teacher, sports coach, pastor) or befriended the victim's family through their standing in the community. The distinction between the PGM principle (diminished weight of good character in repeat offending) and the s 21A(5A) question (whether good character facilitated the offence) must be maintained.
