A sentencing judge is obliged to expressly assess whether an offender's moral culpability is reduced by mental illness when the evidence before the court indicates that mental disorders may have contributed to the offending, even where counsel does not specifically submit on the point. Failure to do so constitutes specific error. However, such error does not necessarily result in a lesser sentence upon re-exercise of the sentencing discretion.
