A family provision claim by a de facto partner will be dismissed where the testator's will makes adequate provision having regard to the applicant's own financial resources (here exceeding $1 million after the estate distribution), the comparatively greater needs of other beneficiaries, and the nature of the relationship. Freedom of testamentary disposition remains a prominent feature and fairness and equality are not touchstones for relief under the Succession Act 2006 (NSW).
