A magistrate constituting the Court of Summary Jurisdiction under the Justices Act (NT) has no implied power to dismiss a complaint for failure to comply with pre-trial directions. The mandatory scheme in ss 64, 67, 68 and 69 requires charges to be put and the matter heard and determined. Alternative enforcement mechanisms include proceeding on available material, refusing to admit evidence not disclosed in accordance with directions, and granting a permanent stay where non-compliance has produced irremediable prejudice.
