The Ambrosoli approach to 'circumstances' in s 93B(2) of the Evidence Act 1977 (Qld) is confirmed: the focus is on the circumstances of the making of the representation, not on the reliability of the facts asserted in it. Prior or later statements of the maker may be considered only insofar as they bear on the circumstances of the making, not on the asserted fact. Once a pre-trial ruling under s 590AA admits evidence under s 93B, the Crown is not required to re-establish the preconditions at trial, and the mere fact that evidence as given does not specify the temporal relationship between representation and event does not require the ruling to be revisited.
