Where a prisoner is held in custody beyond a parole release date solely because s 199(2) of the Corrective Services Act 2006 (Qld) prevents release on parole due to a pending charge, the entire period of custody is declarable under s 159A(1) of the Penalties and Sentences Act 1992 (Qld) as time served under the sentence for that charge. The operation of s 199(2) does not constitute being held 'for another reason' within the meaning of s 159A(1). A long criminal history predominantly involving dishonesty offences cannot justify a sentence for manslaughter that is disproportionate to the gravity of the offence where the killing resulted from an almost innocuous act with unusual fatal consequences.
