The statutory requirements for a signed written contract under ss 29 and 31 of the Sugar Industry Act 1999 (Qld) are met where the supply and payment terms are contained in writing that existed at the time of signing and is directly or indirectly referred to in other writing signed by the parties, even if the signed page itself contains no contractual terms. Projection of contractual terms onto a screen constitutes 'writing' for the purposes of the Act. A party who signs an execution page identified by heading and form as part of a named agreement, in circumstances where the terms have been displayed and explained, manifests assent to be bound by those terms and cannot later deny the existence of a binding contract.
