The detriment requirement in s 359B(d) of the Criminal Code applies to the stalking conduct as a whole, not to each individual act in isolation; an act that does not independently cause detriment may still form part of the course of conduct constituting unlawful stalking. The jury must be unanimously agreed on the identity of the specific acts constituting the offence under s 359B, following KBT and Hubbuck, and the Victorian approach in Hoang does not apply to the Queensland provision. Emails containing serious allegations admitted to be without foundation are not protected by s 359D(c) or (e). The proviso in s 668E(1A) may be applied to a failure to direct on jury unanimity where the evidence of guilt is overwhelming.
