The six-month time limit for applying to exclude property from automatic forfeiture under s 74 of the Criminal Assets Confiscation Act 2005 (SA) cannot be extended by s 47(1) of the Limitation of Actions Act 1936 (SA), both because automatic forfeiture involves no 'cause of action' and because the time limit is essential to the forfeiture regime under s 47(2)(d). The day of conviction for these purposes is the day the guilty plea is entered and allocutus administered, not the date of sentencing. The Court left open whether s 47 can ever apply to time limits in legislation enacted after s 47 came into force.
