Rule 57 of the Supreme Court Civil Rules 2006 (SA) empowers the Court to order a prospective amendment to a statement of claim to introduce a new cause of action that is statute barred, together with an application for an extension of time, even where the new cause of action does not arise out of substantially the same facts as the original cause of action. Rule 54(6) does not limit this power because it addresses only retrospective amendments.
