A community service order may be imposed for a drink-driving offence under s 17(3) of the Road Safety (Alcohol and Drugs) Act 1970 (Tas), but only in conjunction with a fine of at least the minimum amount specified in the Table or a sentence of imprisonment (which may be suspended). A standalone community service order without a fine or imprisonment is not available. Section 12 of the Sentencing Act 1997 (mitigation of imprisonment for custodial offences) does not apply to drink-driving offences because they are not 'custodial offences' within the meaning of that section.
