A plaintiff claiming [name withheld] v [name withheld] damages need not have paid compound interest to their lender in order to recover compound interest as damages. Where the defendant's wrong caused the plaintiff to carry increased borrowings, the cumulative effect of the inability to reduce principal each month justifies compound interest even where the plaintiff's banking arrangements meant interest was not compounded. Damages under s 37 of the Fair Trading Act 1990 (Tas) for interest losses are assessed in the same way as at common law.
