In a joint criminal trial, it is impermissible for the prosecution to invite the jury to use evidence admissible only against a co-accused to enhance the credibility of a common witness in the case against another accused, and a trial judge's endorsement of such an invitation may constitute a substantial miscarriage of justice. The majority articulated a seven-point framework of principles governing the separate consideration requirement in joint trials. The dissent (Maxwell P) would have held that credibility enhancement is an inevitable and accepted feature of joint trials that does not by itself establish a miscarriage of justice.
