Where a Medical Panel finds that a worker's injury is an aggravation of a pre-existing condition caused by the worker's duties, the Panel must consider whether a return to those duties would further aggravate the condition; failure to do so constitutes jurisdictional error. The 60-day time limit in s 68(1) of the Accident Compensation Act 1985 runs from the date the Medical Panel is convened, not from the date the Convenor receives the referral. Non-compliance with the time limit does not invalidate the Opinion.
