A stay of execution pending appeal will be refused where no appeal has been filed, no arguable grounds have been identified, and the prospective appeal is wholly speculative, even where the applicant faces bankruptcy or winding up. The prospect of bankruptcy does not necessarily render an appeal nugatory, as a trustee in bankruptcy may permit the appeal to proceed.
