Claims for compensation under ss 1317H and 1324 of the Corporations Act 2001 (Cth) cannot be brought in the County Court of Victoria, as the definition of 'Court' in s 58AA does not extend to that court. Where proceedings are transferred from a court that lacked jurisdiction, interlocutory orders made by the transferring court (including leave to amend pleadings) should be reconsidered afresh by the receiving court. An order nunc pro tunc cannot be used to overcome limitation periods that extinguish substantive rights, as opposed to mere procedural irregularities.
