A psychological consequence of permanent disfigurement may be taken into account when assessing seriousness under s 93(17)(b) of the Transport Accident Act 1986, by the same reasoning process as applies in paragraph (a) cases following Richards v Wylie. The level of detail about consequences required in a paragraph (b) disfigurement case need not match that ordinarily seen in a paragraph (a) case, as the consequences of scarring are not likely to be something about which one can dilate at length.
