A CCO of substantial duration with extensive conditions can satisfy sentencing purposes for intentionally causing serious injury where the offender has both intellectual disability and operative PTSD, even though the offence would ordinarily attract a medium term of imprisonment. The combination of intellectual disability and operative mental illness (PTSD) provides two separate and cumulative bases for reduced moral culpability and reduced significance of general and specific deterrence. Treatment and rehabilitation conditions may be included under a Justice Plan rather than directly in the CCO to allow Disability Client Services to provide coordinated intervention.
