Where a co-conspirator who has pleaded guilty to the conspiracy charge gives evidence at the trial of another alleged co-conspirator, the trial judge must direct the jury that the plea of guilty is not admissible against the other accused as evidence of the existence of the conspiracy or of the other person's participation in it. However, the failure to give such a direction does not necessarily result in a miscarriage of justice where the appellate court is independently satisfied beyond reasonable doubt of the appellant's guilt on its own assessment of the trial record.
