A sentence of 2 years' imprisonment (with release on recognisance after 12 months) on each of six concurrent charges of giving false evidence to the ACC under s 33(1) was upheld where the lies were premeditated, persistent, and effectively thwarted the ACC's investigation. General deterrence is a matter of considerable weight in sentencing for offences against ACC examinations. First instance sentencing decisions are of limited utility for federal sentencing consistency, which is to be achieved through intermediate appellate courts.
