Under the Criminal Injuries Compensation Act 2003 (WA), deductions under s 42(3) for compensation received from other sources (including workers' compensation) are made from the compensation award as determined under s 30 read with the statutory maximum in s 31. Where the amount received from other sources exceeds the statutory maximum, no compensation is payable under the Act. The term 'compensation award' in s 42(3) bears its defined meaning and cannot be read as a 'notional' uncapped assessment. Re Korber (1992) should not be followed insofar as it reflects a contrary construction.
