A sentence of 3 years 9 months detention for a juvenile aged 15 years 11 months for sexual penetration without consent committed during an aggravated burglary was upheld as within the sound sentencing discretion, where the offence involved a home invasion, a vulnerable victim asleep and alone, and violent oral penetration. A minimum period of 50% of the total sentence under s 121 of the Young Offenders Act 1994 (WA) was within the sound discretionary range.
