Part 4.3 of the Road Transport (Third-Party Insurance) Act 2008 (ACT), including the abrogation of client legal privilege under s 109(2), applies only to documents coming into a party's possession before court proceedings are commenced. After proceedings are commenced, disclosure is governed by Part 2.8 of the Court Procedures Rules 2006 (ACT), which preserves client legal privilege. Medical reports obtained by an insurer after the commencement of proceedings are not subject to compulsory disclosure under the TPI Act.
