A combination sentence under s 29(1)(a) of the Crimes (Sentencing) Act 2005 (ACT) may not include both full-time custody and periodic detention. Where such an error occurs, a mathematical conversion of periodic detention days to full-time custody days is not an appropriate method of correction because periodic detention is qualitatively different from full-time custody. The continuous deprivation of liberty in full-time custody is not linear in its seriousness.
