Whether a document accompanying a development application is 'required' under s 139(2)(d) of the Planning and Development Act 2007 (ACT), and therefore an 'associated document' under s 30, depends on whether it is a necessary part of responding to the relevant rules or criteria, not merely whether it was voluntarily provided. However, failure to publish such a document does not automatically invalidate a subsequent development approval; the Project Blue Sky test requires assessment of the legislative purpose, the nature of the non-compliance, and the practical consequences. Standing to challenge a decision does not of itself establish an entitlement to procedural fairness before the decision was made.
