An intensive correction order under the Crimes (Sentencing) Act 2005 (ACT) is a sentence of imprisonment that sits just below full-time imprisonment and above a suspended sentence in the sentencing hierarchy. It is a punitive sentencing option that should be considered before full-time imprisonment is imposed under s 10, and the obligation to consider alternatives cannot depend on what counsel proposes. The fact that an applicant will serve substantially all of the custodial portion of a sentence before an appeal can be heard constitutes special or exceptional circumstances for bail pending appeal.
