Legal practitioners who rely on their client's instructions and sworn evidence as the basis for a reasonable belief that a claim has reasonable prospects of success are not liable under s 348 of the Legal Profession Act 2004 (NSW) merely because the trial judge ultimately rejects the client's evidence. The NSW Cross-Vesting Act does not empower the Supreme Court to transfer proceedings to the Federal Circuit Court.
