The NCAT Appeal Panel must address the substantive merits of a claim rather than refusing relief on the basis that the first instance Tribunal relied on the wrong statutory provision. The Appeal Panel has power under s 81(1) of the CAT Act to remit matters for reconsideration under the correct provisions, and the Tribunal's error of law in citing the wrong section cannot itself be a discretionary reason for refusing to remit. Both the Tribunal and Appeal Panel are required by ss 36 and 38(4) of the CAT Act to resolve the real issues without regard to technicalities or legal forms.
