The Court of Appeal vacated notations made at a prior directions hearing that had the unintended effect of binding the appeal court to a particular course when determining a motion to lead further or fresh evidence. Payne JA confirmed that the usual discretion of the appeal court to admit fresh evidence, permit responsive evidence, or remit the matter must not be constrained by interlocutory notations of agreement between the parties. The matter was relisted for hearing.
