Section 7B(1) of the MAC Act deems fault only on the part of the owner or driver whose use or operation of the vehicle was causally involved in the blameless motor accident. A driver who is not the owner cannot recover damages from the owner under the blameless accident provisions where the owner had no involvement in the use or operation of the vehicle. An owner/driver cannot sue themselves under s 7B, which deems fault but does not deem liability or involvement in use or operation. Section 7E is capable of applying in single-vehicle blameless accidents, but riding at a lawful and reasonable speed does not constitute a causative 'act or omission' within s 7E(1).
