Where issues have been ordered for separate determination and the primary judge has resolved some but not all of those issues, leave to appeal at the interlocutory stage requires a very clear case of error, particularly where the parties will enjoy an appeal as of right once all issues are determined at first instance. The fact that it was the applicant who initiated the splitting of the litigation is a relevant consideration. Appeals lie from orders, not from obiter observations in reasons for judgment.
