An appellate court will not disturb a trial judge's credit-based findings where the appellant cannot identify incontrovertible facts, uncontested testimony, or compelling inferences inconsistent with those findings. A party who fails to object to a procedural matter at trial (such as the substitution of an expert witness) and does not seek an adjournment cannot raise procedural unfairness on appeal, particularly where the substitute evidence was not materially different from the original. In bailment claims, the bailor bears the onus of proving damage occurred during the bailee's possession before the burden shifts to the bailee to prove reasonable care.
