Relevant prejudice from late-served evidence is procedural or substantive prejudice resulting from the late service, not disadvantage resulting merely from the fact that the evidence is adverse. Courts are reluctant to grant leave to appeal interlocutory case management decisions where reversal would not avoid a trial and the applicant may challenge the interlocutory orders on appeal from the final judgment.
