The Court held that the pro bono referral scheme under UCPR Div 9, Pt 7 is only applicable to proceedings in the Supreme Court (including the Court of Appeal) and does not empower the Court to make a referral for pro bono assistance in relation to a High Court special leave application. A partial referral was granted for advice on the leave already granted by the Court of Appeal, but the application for assistance regarding a prospective High Court application was refused both for want of power and insufficient prospects of success.
