An offer of compromise under UCPR r 20.26 made jointly to two defendants cannot be accepted by one defendant alone, and the offeror cannot rely on the costs consequences under r 42.14 against that defendant. Where a party succeeds on appeal but abandoned some grounds, a percentage reduction in costs recovery (here 70%) may be appropriate. Where a successful party at trial lost the clearly dominant and severable issue, the court may depart from the general rule that costs follow the event and order each party to bear their own costs.
