A permanent injunction restraining use or copying of identified confidential documents does not, without more, have a realistic worth exceeding the monetary threshold for leave to appeal where the injunction is addressed to documents rather than to future business practices. The springboard doctrine addresses temporal advantage, and where the advantage from copying software features (as distinct from source code) has passed, refusal of further injunctive relief is within the primary judge's discretion. A property return covenant requiring return of 'copies' extends to documents containing cut-and-pasted confidential material but may not extend to independently coded software incorporating copied features or functionality.
