An application to reopen a judgment under UCPR r 36.15 on the ground of irregularity faces even more demanding constraints than an application within the 14-day period under r 36.16(3A). Difficulties experienced by a prisoner in conducting litigation, including lack of access to legal materials, do not constitute 'legal incapacity' under r 7.13 and do not render a judgment 'irregular' under r 36.15 where those matters were known to the court or could have been raised at the hearing.
