A vendor who obtains a money judgment for the unpaid purchase price as a means of enforcing an order for specific performance is taken to have elected that remedy and is precluded from subsequently seeking to set aside the specific performance order and recover the property. The contractual rights and obligations in respect of the unpaid purchase price merge in the money judgment. A court at first instance has no power to vacate or set aside orders of an appellate court. The question whether a party may terminate a contract after an order for specific performance without first obtaining vacation of that order was left open.
