Under s 263 of the Local Government Act 1993 (NSW), the examination and report function is confined to the specific proposal referred by the Minister; a council's own separate amalgamation proposal lodged under s 218E is not a mandatory relevant consideration in the examination of the Minister's proposal. However, alternative boundary configurations raised in submissions to the delegate within the submission timeframe may be considered by the delegate. The distinction between a 'modification' and a 'new proposal' under s 218F(7) determines whether the Minister may recommend implementation or whether a fresh examination and report process is required.
