A single act of digital penetration of a child aged 5 years 10 months by an uncle in a position of trust, where the offending persisted despite the child's complaint of pain and ceased only upon fear of detection, falls below the mid-range of objective seriousness for s 66A offences but not by very much, and warrants a sentence of 6 years imprisonment with a 4-year non-parole period. A characterisation of such offending as 'towards the lower end of the range' is erroneous.
