Appellate courts will be reluctant to interfere with a trial judge's discretionary decision to vacate a trial date where the judge has considered all material factors including the seriousness of charges, the importance of oral evidence, the Crown's conduct, and the effect of delay on the accused. The NSWCCA endorsed the view that Crown subpoenas should be served promptly after a trial date is fixed, not merely 21 days before trial.
