A finding beyond reasonable doubt that an offender applied force to a victim cannot be sustained where the only evidence is equivocal DNA under the victim's fingernail and the offender has consistently denied striking the victim. In re-sentencing for constructive murder based on extended common purpose, the offender's culpability should be regarded as lower than the co-offender who actually inflicted the violence.
