Section 23 of the Crimes (Sentencing Procedure) Act 1999 (NSW) applies to voluntary disclosure of an offender's own otherwise unknown offences (the Ellis discount), requiring the sentencing judge to specify the discount given. Failure to do so constitutes specific error. Ongoing drug supply activity following knowledge of an end user's death is a significant aggravating factor warranting custodial sentence, but indicative sentences must not reflect punishment for the death itself where the offender is not charged with causing it.
