Knowledge of the involvement of a commercial quantity of a particular drug is an essential element of the offence under s 25(2) of the Drug Misuse and Trafficking Act 1985 (NSW), and a trial judge must direct the jury on this element. Failure to do so constitutes a misdirection warranting quashing of the conviction.
